nyxalis I’m not trying to defend Gamer, but based on the information I have, you likely do not have the right to sue Gamer even if he violates the license.
According to Gamer, your project is closed source, but is licensed under the AGPLv3 license (if not, please respond to this claim). As the AGPLv3 license requires you to make the source code of all copies and derivatives of the software public, you’re essentially violating your own license. Thus, you may not be able to apply the AGPLv3 license to your project as you’re trying to license a closed source project under an open source license.
To address this:
- Change your license to a proprietary one, or
- Make your code open source to ensure the AGPLv3 license can apply
